Samsung obtains ban on old iPhones - Spiegel Online

Washington – This decision is likely the biggest stage victory for Samsung in patent war against Apple will be: The U.S. Trade Commission, ITC provides a mobile-patent infringed by the South Korean five Apple products, and therefore has banned their importation into the country. Affects older models of the iPhone and iPad, the de facto could be banned from the U.S. market. The devices are made in China, so must be imported for sale in the United States.

Specifically, it is the decision to include models of the iPhone 4, iPhone 3 and 3GS and the iPad and iPad 2 with wireless connection – but only to devices that have been sold through major American mobile operator AT & T. This used to be the exclusive partner of Apple in the U.S..

Some of these versions are still available in the U.S. as an inexpensive entry-level models. Therefore, the Federal Trade Commission issued a ban on sales of devices that are already in the country. The current generation devices – ie the iPhone 4S and the iPhone 5 as well as the newer iPads – are not affected

. standard patent for UMTS affected

The import ban will not enter into force in 60 days – which are two Apple hopes to avert it: President Barack Obama could tip it with a veto. He had presented a package of measures against the abuse of patent lawsuits immediately prior to the announcement of the ITC’s decision. One of the points is to limit the flood of ITC lawsuits. Apple also wants Chart Show appeal against the judgment. As long as the devices will also be available, according to Apple.

The success of Samsung Chart Show is tricky but for the entire industry: The affected U.S. patent belongs to the foundation of the fast UMTS data transmission format. Therefore, Samsung has to offer it to existing rules on fair terms and without discrimination licenses. Apple keeps the required fee by Samsung as too high.

the EU Commission accuses the South Koreans against misuse of standard patents, U.S. authorities also determined. Therefore Samsung screwed complaints with such rights massively.
